Terms of Use

These Terms of Use are the agreement between you and Diversey Labs LLC ("Diversey Labs," "we," or "us"), the maker of Trueward, for your use of the Trueward app and the trueward.app website. We've kept them as plain as we can — but they're the real, binding terms, so they're worth reading. They include important disclaimers about health and behavior-change goals, a limit on our liability, and an agreement to resolve most disputes by arbitration.

01Agreeing to these terms

Trueward is made by Diversey Labs LLC, an Illinois limited liability company. By downloading, installing, or using Trueward, you agree to these Terms of Use and to our Privacy Policy. If you don't agree, please don't use the app. If you're setting Trueward up on behalf of someone else, you're confirming you're allowed to accept these terms for them.

02Who can use Trueward

You need to be old enough to enter a binding contract where you live to use Trueward on your own. If you're younger than that, you may use Trueward only with a parent or legal guardian who agrees to these terms on your behalf, and the app isn't intended for children under 13. You also agree to follow the App Store's Usage Rules, which are part of these terms.

03Your license to use Trueward

We grant you a personal, non-exclusive, non-transferable, revocable license to use Trueward on Apple devices you own or control, as permitted by the App Store's Usage Rules. This is a license to use the app — you don't own the app itself, and the license ends if you stop abiding by these terms.

04Trueward Pro and subscriptions

Trueward is free to download and offers an optional auto-renewing subscription, Trueward Pro, which unlocks unlimited goals, targets, and habits, the full reflection journal with history, and the monthly close ritual. Trueward Pro is offered on monthly and annual plans, and a free trial may be available.

The current price, billing period, and any free trial are always shown in the app before you buy. Prices may vary by region and can change over time.

05Billing, renewals, and cancellation (handled by Apple)

All payments are processed by Apple through your Apple Account — we never see or store your payment details. Your subscription renews automatically unless you turn off auto-renew at least 24 hours before the end of the current period, and Apple charges you for renewal within 24 hours of the period ending.

You can manage, change, or cancel your subscription anytime in your App Store account settings. Any unused portion of a free trial is forfeited when you buy a subscription, and refunds are handled by Apple under its policies, not by us.

06Apple's terms also apply

Trueward is distributed through the App Store, so Apple's standard End User License Agreement applies to your use of the app in addition to these terms; where they overlap, both are in effect. Apple is a third-party beneficiary of these terms and may enforce them. Apple has no obligation to provide support or maintenance for the app, and isn't responsible for any product warranties, claims, or losses relating to it — those are between you and us.

07Acceptable use

Please use Trueward lawfully and for its intended purpose — tracking your own goals and habits. Don't reverse-engineer, decompile, or attempt to extract the source of the app except to the limited extent the law expressly allows; don't resell, rent, redistribute, or sublicense it; and don't use it to do anything unlawful or to interfere with how it works for others.

08Your content and feedback

The goals, targets, habits, notes, and reflections you create are yours. Because Trueward stores them on your device — and in your own iCloud if you enable sync — we don't host, access, or claim any rights to your content, and you're responsible for keeping your own backups, which iCloud can help with.

If you choose to send us feedback or suggestions, you grant us a non-exclusive, royalty-free, perpetual license to use them to improve Trueward, with no obligation to you.

09Trueward is not medical or professional advice

Trueward is a self-tracking and organization tool. It is not a medical device and does not provide medical, health, psychological, mental-health, addiction-treatment, nutritional, dietary, fitness, financial, or other professional advice, diagnosis, or treatment. Nothing in the app is a substitute for the advice of a qualified professional, and using Trueward does not create any doctor–patient, therapist–client, coaching, or other professional relationship between you and us. Any prompts, reminders, or summaries the app shows are for general organizational purposes only.

10Health, wellness, and behavior-change goals; assumption of risk

People use Trueward for all kinds of personal goals, including health- and behavior-related ones — for example, reducing or quitting smoking, alcohol, or vaping; losing weight; changing diet; exercising or training; improving sleep; limiting screen time or other habits; or supporting mental well-being. Trueward simply records and organizes what you choose to track. It does not assess whether a goal is safe or appropriate for you, and it cannot account for your individual circumstances.

You should consult a qualified physician or other professional before starting, changing, or stopping any diet, exercise, supplement, medication, substance-reduction, or other health or wellness program, and you pursue any such goal using Trueward entirely at your own risk. We do not diagnose, treat, cure, or prevent any condition, and we make no promise that using Trueward will help you achieve any particular outcome, or that any goal you track is healthy or attainable for you.

Trueward is not for emergencies. If you're experiencing a medical emergency or a mental-health crisis, or are having thoughts of harming yourself, don't rely on the app — call your local emergency number or a crisis line right away. In the U.S., you can call or text 988 for the Suicide & Crisis Lifeline.

11Disclaimer of warranties

Trueward is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We work hard to make the app reliable, but we don't promise it will be uninterrupted, secure, or error-free, that it will preserve your data, or that it will help you reach any particular goal — it's a tool to support your own effort, not a guarantee of a result. Some jurisdictions don't allow the exclusion of certain warranties, so parts of this may not apply to you.

12Limitation of liability

To the fullest extent allowed by law, Diversey Labs LLC and the people who make Trueward won't be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, for any lost data or lost progress, or for any personal injury or any health, physical, emotional, psychological, or financial harm, arising out of or relating to your use of (or inability to use) Trueward — including any decisions you make or goals you pursue while using it — whether based on warranty, contract, tort, or any other theory, even if we've been advised of the possibility of such damages.

Where liability can't be excluded, our total liability to you for all claims is limited to the greater of the amount you paid us for Trueward in the twelve months before the claim or US $50. Some jurisdictions don't allow certain limitations, so parts of this may not apply to you, and nothing here limits liability that can't be limited by law.

13Indemnification

You agree to indemnify and hold harmless Diversey Labs LLC and its members, officers, and contractors from any claims, damages, losses, liabilities, and reasonable expenses (including legal fees) arising out of your misuse of Trueward, your violation of these terms, or your violation of any law or the rights of someone else.

14Intellectual property

Trueward — including its name, logo, design, copy, and software — belongs to Diversey Labs LLC and is protected by copyright, trademark, and other laws. These terms don't give you any right to use our name or branding except as needed to use the app normally.

15Changes to the app or these terms

We may update Trueward over time — adding, changing, or occasionally retiring features — and we may revise these terms when we do. If we make a material change, we'll update the date above and reflect it in the app. Continuing to use Trueward after a change takes effect means you accept the updated terms.

16Resolving disputes: arbitration and class-action waiver

Please read this section carefully — it affects how disputes between you and us are resolved.

Let's talk first. If you have a concern, email us at hello@trueward.app and give us 30 days to try to resolve it informally. Most issues can be sorted out this way.

Agreement to arbitrate. If we can't, you and Diversey Labs LLC agree to resolve any dispute relating to Trueward or these terms through final and binding individual arbitration, administered by a recognized arbitration provider under its consumer rules, rather than in court. The arbitration may be held near Cook County, Illinois, or conducted remotely.

Class-action waiver. Disputes will be handled on an individual basis only. You and we each waive any right to bring or take part in a class, collective, or representative action.

Your right to opt out. You can opt out of this arbitration agreement within 30 days of first accepting these terms by emailing hello@trueward.app. If you opt out, the Governing law section below applies instead.

Exceptions. Either of us may still bring an individual claim in small-claims court, and either of us may ask a court for an injunction to protect intellectual property. Nothing here stops you from contacting a government agency or exercising rights that can't be waived by law.

17Governing law

These terms are governed by the laws of the State of Illinois, United States, without regard to its conflict-of-laws rules. For any dispute that isn't subject to arbitration, you and we agree to the exclusive jurisdiction of the state and federal courts located in Cook County, Illinois — except where applicable consumer-protection law gives you the right to bring a claim where you live.

18The rest

These terms, together with our Privacy Policy and any Apple terms that apply, are the entire agreement between you and us about Trueward. If any part is found unenforceable, the rest stays in effect. Our not enforcing a provision isn't a waiver of it. You may not transfer your rights under these terms; we may transfer ours in connection with a merger, acquisition, or sale of assets. The sections on your content, disclaimers, liability, indemnification, and dispute resolution survive after these terms end.
